Crofton Lending Corp News 5/7/04

In Crofton Lending Corp. et. al. v. County Utilities Corp., et. al, Court of Special

Appeals of Maryland, No. 0955 (May 4, 2004), the firm was once again successful in an

appeal from the lower court case which secured a judgment valued at over $2 million for its

client against their lender, a swing of almost $11 million dollars since a confessed judgment of

$8.8 million was originally entered against the client in 1995 by the lender. This case, which

involves various disputes among multiple parties over the rights and obligations arising out of

a real estate development known as Crofton Farms, has been hard fought for more than eight

years. During the course of this litigation, the firm has effectively pursued its clients rights

regarding (1) water and sewer assessment charges, (2) school fee and transportation fee

credits, (3) subdivision platting and declarations, (4) foreclosure and (5) attorney fees.

Indeed, the firm’s accomplishments were even commented upon by the lower court judge,

who stated in his opinion, “Counsel ... has had a long, ongoing relationship with the client.

The work has been performed by experienced counsel of excellent reputation and ability.”

Shawn Cavenee, working closely with Roger Simmons, has played a key role in the success
